These terms and the app licence
These Terms of Use describe the conditions for using NOX: Daily Discipline, provided by Paolo Guidicelli, rue pere eudore devroye 86, 1150 woluwe saint pierre, belgique. Contact: sirlebossgzg@gmail.com. Please read them before using NOX. You must have the legal capacity to enter these terms or any authorization from a parent or guardian required by applicable law.
The Apple Standard End User License Agreement governs the licence to the iOS app. These terms supplement that agreement for NOX’s content and services; they do not replace it. If there is a conflict about the app licence, Apple’s Standard EULA applies, subject always to mandatory consumer rights.
Using NOX
NOX provides motivational statements, daily missions, content discovery, local progress and optional reminders in English and French. It requires no NOX account. Premium access requires an active subscription entitlement. Availability depends on a compatible iOS device and supported app version. Internet access is needed for purchase, restoration and subscription verification; access may be unavailable while verification cannot be completed.
Content and features may be corrected or updated. We will respect applicable obligations concerning paid services and will not use an update to remove rights you cannot legally waive.
Acceptable use
Use NOX lawfully and for your personal use. Do not misuse purchase or restoration features, bypass subscription or security controls, interfere with operation, or use the app to infringe another person’s rights. Do not copy, distribute, resell or commercially exploit app content without permission, except where an app feature, the applicable licence or law expressly permits it.
Restrictions on copying, modification or reverse engineering apply only to the extent permitted by law and the applicable licence. Nothing here limits a statutory exception or an authorized accessibility use.
Intellectual property
The NOX name and branding, app design, software and original editorial content are protected by intellectual property laws. Rights belong to the operator or the relevant rights holders. Third-party material remains the property of its owner. Your use gives you the limited rights described in the applicable licence, not ownership of the app or its content.
Subscription plans and trial
NOX Premium is available through two auto-renewing plans:
- Monthly: billed each month. This plan has no free trial.
- Annual: billed each year. Eligible users receive a 3-day free trial before the first annual charge.
The price, currency, billing period and any applicable trial are displayed before purchase in NOX and Apple’s confirmation sheet. Trial eligibility is determined through the App Store; previous introductory offers can affect eligibility. An ineligible user starts the paid annual subscription immediately. No trial is guaranteed simply by installing or reinstalling NOX.
For an eligible annual trial, the annual charge follows the 3-day trial unless you cancel in time. Apple charges the Apple Account used for purchase. RevenueCat validates the subscription and manages Premium access; it does not replace Apple’s billing system.
Renewal and cancellation
Subscriptions renew automatically unless canceled. To avoid renewal after a free trial, cancel at least 24 hours before it ends. Manage cancellation through Apple’s subscription settings; NOX also provides a subscription management entry in Profile. See Apple’s cancellation instructions.
The renewal date, price and access end date are shown by Apple. Cancellation generally stops future renewal; the timing of access ending, including during a trial, follows Apple’s displayed terms and applicable law. Deleting NOX, switching off notifications or contacting support does not cancel a subscription. Any price change is subject to Apple’s notices, consent requirements and applicable law.
Refunds and restoring purchases
Refund requests for App Store purchases are handled by Apple under its policies and applicable law. NOX cannot promise that a request will be approved. See Apple’s refund guidance.
Use Restore Purchases in NOX with the Apple Account used for the purchase to request restoration of eligible subscription access. Restoration does not create a new free trial and does not restore device-only favorites, preferences or progress.
Motivation, not medical advice
NOX is a motivation, productivity and discipline app. Its statements and missions are general informational content, not medical or mental health advice, diagnosis or treatment. NOX is not an emergency service or a substitute for qualified professional care. Choose actions appropriate to your circumstances and do not interpret a motivational statement as an instruction to ignore injury, illness, exhaustion or professional advice. No particular personal, health or productivity result is guaranteed.
Availability and liability
To the extent permitted by law, NOX and its content are provided as available, without a promise of uninterrupted access, error-free operation or a particular outcome. Device settings and platform services can affect reminders, purchases and access. You remain responsible for reasonable decisions about how you use general motivational content.
To the extent permitted by law, the operator is not liable for indirect or consequential loss or lost profits arising from use of the app. This does not exclude or limit liability that cannot lawfully be excluded or limited, including fraud, intentional misconduct, or death or personal injury caused by negligence where protected by law. Statutory consumer guarantees, remedies and rights remain fully applicable.
Changes, disputes and consumer rights
We may update these terms to reflect changes in NOX or legal requirements. The effective date identifies the current version. Material changes will be notified, and any required agreement obtained, as required by law; a change does not retroactively take away accrued rights. If you stop using NOX, separately cancel through Apple to prevent further renewal.
Mandatory protections and rights to bring a claim before a competent court in your jurisdiction remain unaffected. These terms do not impose mandatory arbitration or waive collective or statutory rights. If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. The English and French versions are intended to have the same meaning; neither removes protections available under applicable law.
